Groups sue Mirant Mid-Atlantic over power plant - Sacramento Business Journal:

The federal lawsuit, filed in the U.S. Distric Court in Baltimore, claims that the Chalki Point Generating Plant operatedby Atlanta-based Mirant Mid-Atlantic has spewec unacceptable levels of sulfur dioxide into the air hundred s of times without the appropriate pollutionn controls required under the federal Clean Air Act. A Miranty spokeswoman said thecompany hasn’tr been served with the lawsuitt yet, and can’t comment on the claims.
The Environmentakl Integrity Project, a legal nonprofit founded by formerenforcement attorneys, and Brandes and Kline have filed the lawsuiy on behalf of the Chesapeake Climate Action Network and four including a married couple, Nancy and Norton Dodge, who live sevenh miles away from the plant on a 1,200-acre farm in The Dodges “need to close windows, limit theitr time outdoors and/or cover their faces when they are outdoors to avoidd the respiratory irritants and smell of the pollution from the Chalk Point Power Plant,” the lawsuit reads.

The plaintiffs pointed to a Harvard Universithy 2006 study that showed that such particulates matter pollution from the Chalmk Point plant can have negative effects on the healthj and respiratory systems of people livinbg ina 400-kilometer, or nearly 250-mile, radius of the In their initial notification letter, the plaintiffss wrote that EPA hourly data showzs that two boilers at the Chal k Point plant exceeded allowable levels of sulfut dioxide emissions 591 times in 2006, 726 timesd in 2007 and 113 times in 2008.
Mirantt has said it’s launched a $1.6 billion projecg to install scrubbers andotherd pollution-reducing equipment on its Chalk Poing boilers by the beginning of 2010.
